It is human nature. Last night I was reading Thomas Cahill's "Heretics and Heroes" and in the first chapter he is discussing Boccacio's tale of the Jew from Paris who was asked to convert after he first visited Rome to see the spendor of the Holy See. When he returned he gave a description of the total corruption and depravity among the Cardinals and Pope and how they even flaunted it since they were "above the law" so to speak. It just tells us that this sort of behavior is in our nature and while our founding fathers gave us a tangible method of keeping this at bay, we have succumbed to accepting pork in return for electing crooked politicians etc. etc. etc. There is no magic to cure this other than constant vigil and adherence to good moral behavior and we have fallen short and betrayed those who gave us this nation.

Innocent until PROVEN guilty. No one needs to prove their innocence! It's the job of the prosecutor (or, in this case, persecutor) to prove guilt.
